MEMBERSHIP TERMS
These Membership Terms (these “Terms“) govern your enrollment in the membership program you enrolled in (the “Program”), the paid membership program of the participating restaurant (the “Restaurant”). The Program is administered by Skytale Digital, L.L.C., doing business as Restaurant Growth (“Restaurant Growth” or the “Administrator“), which operates enrollment, billing, and Member support on the Restaurant’s behalf.
By enrolling, you agree to these Terms, including the automatic-renewal and recurring-billing terms in Sections 3 and 4. If you do not agree, do not enroll.
Effective date: October 19, 2026
1. Who Provides What
- Your membership benefits (the “Benefits“), as described to you at enrollment, are offered, prepared, and fulfilled solely by the Restaurant at its locations.
- The Administrator is the Restaurant’s service provider and billing agent. The Administrator operates the enrollment and checkout flow, collects recurring charges through Stripe, Inc. (Section 4), and provides Member support on the Restaurant’s behalf.
- Questions about the Benefits, the menu, hours, or a visit are for the Restaurant; questions about billing, cancellation, pauses, or refunds are for the Administrator (Section 13).
2. Eligibility and Your Account
You must be at least 18 years old (or the age of majority in your state) and legally able to enter into contracts to enroll. You agree to provide accurate enrollment information, keep your payment method current, and keep your account credentials confidential. You are responsible for activity on your account.
3. Automatic Renewal: Read This Carefully
The Program is a subscription that renews automatically.
- Automatic renewal. Your membership renews automatically at the price and billing period shown to you at enrollment (plus any applicable taxes) until you cancel.
- Your express consent to recurring charges. By enrolling and providing a payment method, you give your express, affirmative consent to be charged the recurring amount described here and in the signup flow, on the schedule described, until you cancel. This consent is separate from your agreement to the rest of these Terms and is captured at checkout before your first charge.
- Free or discounted trial / first-period offer. If you enrolled under a trial or introductory offer, that offer covers the trial period only. Your membership will then automatically convert to the standard price and billing period shown to you at enrollment, and your payment method will be charged, unless you cancel before the offer period ends. We will send you a reminder before the conversion charge as described in Section 5.
- Price changes. If the price of the Program changes, we will notify you in advance as required by law, and the new price will apply starting with the billing period after the notice period. If you do not agree to the new price, cancel before it takes effect.
- Nothing in this Section limits any renewal rights provided by the law of your state.
4. Billing
- Payment processor. All charges are processed by Stripe, Inc. We never receive or store your full card number on our systems.
- Authorization. By enrolling, you authorize the Administrator, as the Restaurant’s billing agent, to charge your payment method for the recurring membership price, plus applicable taxes, on each billing date until you cancel.
- Statement descriptor. Charges will appear on your statement as “RG*” followed by a short identifier for the Restaurant or a similar identifier naming the Program or the Administrator.
- Billing date. Charges occur on or near your enrollment anniversary each billing period. If that date does not exist in a given month, we charge on the nearest preceding business day.
- Failed payments. If a charge fails, we may retry the payment method and notify you. If payment remains unresolved, your membership and Benefits may be suspended until payment succeeds.
- Keeping your card current. Update or replace your card through your membership page; cancel under Section 6; updating or replacing a card does not cancel your membership.
5. Confirmations and Reminders We Send You
When you enroll, we send you an enrollment confirmation restating your price, billing frequency, renewal and trial terms, and exactly how to cancel, with a direct cancellation link. We will also send:
- A reminder before any free or discounted trial converts to paid billing;
- A renewal reminder before any renewal for a term of one year or longer, where applicable, and before any renewal charge that follows a period in which you were not charged;
- Advance notice of material changes to the Program or these Terms, including price changes, before they take effect; and
- A cancellation confirmation immediately when you cancel (Section 6).
Keep your email and mobile number current so these reach you; you can update them through the support contact in Section 13.
6. How to Cancel: Simple, Online, Any Time
You may cancel at any time, in the same way you signed up:
- Online (fastest): open your membership page, linked in your confirmation and reminder emails, and click Cancel Membership; or
- Email: send “Cancel membership” to luke@restaurantgrowth.com from the email address on your membership.
No phone call, no chat session, no retention interview, and no cancellation fee are ever required. Cancellation takes effect at the end of your current paid billing period; you keep your Benefits until then, and no further charges will be made. You will receive an immediate on-screen and email/text confirmation that your cancellation is recorded, with its effective date. If you believe you were charged after cancelling, contact us (Section 13) and we will make it right, including refunding any charge made after a properly recorded cancellation.
7. Pausing Your Membership
If the Program offers pausing, you may pause your membership on the pause terms shown to you at enrollment, from your membership page, linked in your confirmation and reminder emails. While paused, you are not charged and Benefits do not accrue; your membership resumes automatically at the end of the pause unless you cancel during it.
8. Refunds
- Charges for a begun billing period are generally non-refundable; Benefits remain available through the end of the period.
- We will refund: duplicate charges; charges made after a recorded cancellation; charges resulting from our or the Restaurant’s error; and amounts required to be refunded by law.
- Program-terminated/Restaurant-closed prepaid value is handled under Section 10.
- Refunds go to your original payment method, typically within 5-10 business days of approval. To request a refund, contact Section 13.
9. Benefits: Availability and Changes
The Restaurant fulfills all Benefits at its locations, subject to availability, hours, and applicable law. Benefits may change from time to time; material adverse changes will be disclosed in advance, and you may cancel under Section 6 if you do not agree. Unused periodic Benefits expire at the end of each billing period unless the signup flow states otherwise. Benefits have no cash value except as required by law or as stated in Section 10.
10. If the Program Changes Hands or Ends: Your Paid Value Is Protected
Your trust is the Program. Accordingly:
- If the Restaurant changes program administrators, your membership, your paid-through date, and your Benefits will be honored by the Restaurant through the end of your paid period, and, where you consent and payment rules allow, your membership may be migrated to the new administrator so it continues without interruption.
- If the Program is permanently discontinued, we will give you at least 30 days’ notice before the final billing date, stop all recurring charges as of discontinuation, and the Restaurant will honor Benefits through your paid-through date or refund the unused prepaid portion.
- Neither the Restaurant nor the Administrator will charge you after a discontinuation or migration date except to complete a period you already paid for.
11. Messages From Us (Email and Text)
- Transactional messages. We send enrollment confirmations, billing receipts, renewal and trial reminders, cancellation confirmations, and other messages necessary to administer your membership. These are part of the Program and are not optional while you are a Member.
- Marketing messages. We send marketing emails or texts only with your separate opt-in, collected through an unchecked-by-default box at signup. Marketing consent is not a condition of membership. You may opt out at any time: reply STOP to texts or use the unsubscribe link in emails. Opting out of marketing does not stop transactional messages.
- Signup records. The Administrator keeps a record of your enrollment and consents, the date, time, terms version, price and renewal disclosure shown, and the action you took, which we retain as proof of your authorization and provide to you on request.
12. Privacy
Personal information for the Program is handled under the Administrator’s Privacy Policy (restaurantgrowth.com/privacy) and the Restaurant’s privacy practices. In short: the Restaurant owns its Member relationships; the Administrator processes Member information only as the Restaurant’s service provider to run the Program; payment data is handled by Stripe; and Member information is not sold.
13. Member Support
- Billing, cancellation, pause, and refund help: luke@restaurantgrowth.com (support hours and response times are posted on your membership page)
- Food, service, and visit questions: contact the Restaurant directly.
14. Liability; Disputes
To the maximum extent permitted by law, the Restaurant and the Administrator are not liable for indirect, incidental, consequential, or punitive damages arising from the Program, except for our own gross negligence or willful misconduct, and our total liability for any claim is limited to the amounts you paid for the membership in the 12 months before the claim arose. These Terms are governed by the laws of Arizona, without regard to its conflict-of-laws principles. Consumer-protection and automatic-renewal laws of the Member’s home state may also apply. If you have a dispute, please contact support (Section 13); most billing problems are ours to fix, and we will.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be disclosed in advance with the effective date; continued membership after the effective date constitutes acceptance. If you do not agree to a change, cancel under Section 6 before it takes effect.
16. General
These Terms are the entire agreement between you, the Restaurant, and the Administrator regarding the Program. If any provision is found unenforceable, the remaining provisions continue in full force. Our failure to enforce a provision is not a waiver. You may not assign your membership; the Restaurant may assign the Program as described in Section 10.
